Patent in India 

A patent is an exclusive right granted by the Government of India to an inventor for an invention, preventing others from making, using, selling, or distributing the invention without permission for a limited period (usually 20 years). Patents in India are governed by the Indian Patents Act, 1970, and administered by the Office of the Controller General of Patents, Designs & Trade Marks (CGPDTM) under the Ministry of Commerce & Industry.

Patentable Inventions

  • Must be novel (new and not published anywhere in the world).

  • Must involve an inventive step (not obvious to a skilled person).

  • Must be industrially applicable (capable of being made or used in an industry).


Non-Patentable Inventions (as per Section 3 & 4 of the Patents Act)

 

  • Laws of nature, mathematical or business methods, algorithms.

  • Plants, animals, or biological processes (except microorganisms).

  • Traditional knowledge and discoveries of natural substances.

Patent Application Process in India

 

  • Step 1: Patent Search & Drafting

  • Step 2: Filing the Patent Application (Provisional or Complete)

  • Step 3: Publication of the Application (after 18 months)

  • Step 4: Examination Request & Review

  • Step 5: Grant of Patent (if no objections)

  • Step 6: Renewal & Maintenance (annually for 20 years)

Unlike trademarks (™ for unregistered and ® for registered),
But patents do not have a universally recognized symbol. However, the following are used to indicate a patent:

  • Patent Pending – Used when a patent application is filed but not yet granted.

  • Patented (IN Patent No. XXXXXXX) – Used after the grant of a patent, mentioning the patent number.

  • Ⓟ (Rarely used) – Sometimes seen in informal contexts, but not legally recognized.
